BEWARE! Under Florida law the courts require that to a lender must produce a promissory note if the lender seeks to foreclose. If the lender cannot provide the original promissory note, a copy will suffice. However, under no circumstances can the lender foreclose if the lender is unable to prove that the lender is the legal owner of the promissory. Over the past few years lenders have been bundling and selling many mortgages and promissory notes are easily lost. When you are served with foreclosure papers seek out the advice of an experienced attorney to make sure the lenders are complying will applicable State Laws. If the lender is not the legal owner of the promissory note or cannot produce it in a foreclosure suit, you may be able to have your case dismissed!
